Governing the use of IMG9 at img9.net
These Terms and Conditions ("Terms") govern your access to and use of img9.net and the IMG9 application ("Service"). By accessing or using the Service, you agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you shall not access or use the Service.
IMG9 is provided free of charge. No payment, registration, or account creation is required. Your use of the Service constitutes acceptance of these Terms.
IMG9 is a browser-based image processing application that performs format conversion, compression, cropping, scaling, and preset-based image exporting. All processing executes entirely within your browser through client-side JavaScript. The Service transmits no user image data to any server. IMG9 maintains no user accounts, databases, or server-side file storage.
THE SERVICE IS PROVIDED ON AN "AS IS," "WHERE IS," AND "AS AVAILABLE" BASIS, WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE OPERATOR OF IMG9 EXPRESSLY DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, COMPLETENESS, TIMELINESS, AND FREEDOM FROM ERRORS OR INTERRUPTIONS.
The Operator makes no representation or warranty that: (a) the Service will meet your requirements or expectations; (b) the Service will be available on an uninterrupted, timely, secure, or error-free basis; (c) any output produced by the Service will be accurate, reliable, complete, or suitable for any particular purpose; (d) any defects in the Service will be corrected; or (e) the Service is free of viruses or other harmful components.
You expressly acknowledge and agree that your use of the Service is at your sole risk. Any material downloaded, processed, or otherwise obtained through the use of the Service is accessed at your own discretion and risk, and you shall be solely responsible for any damage to your device, data loss, or other harm that results from such use.
IMG9 operates within the constraints of your browser's capabilities, your device's available memory, and the specifications of the underlying web platform APIs. The Operator makes no guarantees regarding the following:
IMG9 IS NOT DESIGNED, INTENDED, OR WARRANTED FOR USE IN ANY APPLICATION WHERE FAILURE, INACCURACY, OR MALFUNCTION COULD RESULT IN DEATH, PERSONAL INJURY, SEVERE PHYSICAL OR ENVIRONMENTAL DAMAGE, FINANCIAL LOSS, LEGAL LIABILITY, OR BREACH OF ANY REGULATORY OR COMPLIANCE OBLIGATION.
You shall not rely on IMG9 as the sole or primary tool for any mission-critical, safety-critical, legally mandated, medically relevant, or compliance-dependent image processing workflow. This includes, without limitation: medical imaging, forensic evidence processing, legal document preparation where output accuracy carries legal consequence, aviation or navigation imagery, emergency response materials, or any context where image output errors could cause harm.
If you choose to use IMG9 for professional, commercial, or high-stakes purposes, you do so entirely at your own risk and you accept full responsibility for independently verifying all output before use.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE OPERATOR OF IMG9, ITS AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, REVENUE, GOODWILL, DATA, USE, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE, REGARDLESS OF THE LEGAL THEORY, WHETHER OR NOT THE OPERATOR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE MAXIMUM AGGREGATE LIABILITY OF THE OPERATOR FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL AMOUNT YOU PAID TO THE OPERATOR FOR USE OF THE SERVICE, WHICH IS ZERO (€0.00).
This limitation applies to all causes of action in the aggregate, including without limitation breach of contract, breach of warranty, tort (including negligence), strict liability, and any other legal or equitable theory. Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, the liability of the Operator shall be limited to the fullest extent permitted by applicable law.
You agree to indemnify, defend, and hold harmless the Operator of IMG9, its affiliates, directors, officers, employees, agents, licensors, and service providers from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable legal fees and court costs) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law, regulation, or third-party right; (d) any content you process through the Service; or (e) any dispute between you and any third party relating to output produced using the Service.
This indemnification obligation shall survive the termination of these Terms and your cessation of use of the Service.
You shall not use IMG9 for any purpose that is unlawful or prohibited by these Terms. Without limitation, you agree not to use the Service to process, convert, modify, or export:
The Operator reserves the right to cooperate with law enforcement authorities and to comply with valid legal processes requiring disclosure of information to the extent any such information exists.
IMG9 claims no rights, licenses, or ownership over any images you process through the Service. Your content remains your property at all times. Because the Service operates entirely within your browser and transmits no image data to any server, the Operator has no technical access to your content.
The IMG9 name, logo, user interface, underlying source code, and all associated intellectual property are the property of the Operator or its licensors and are protected by applicable intellectual property laws. These Terms grant you no right to use the IMG9 name, logo, or branding for any purpose beyond normal use of the Service.
The Operator reserves the right, at its sole discretion and without prior notice, to: (a) modify, update, or discontinue the Service or any part thereof at any time; (b) change the features, functionality, or user interface of the Service; (c) impose limits on certain features or restrict access to parts or all of the Service; and (d) modify these Terms. Continued use of the Service after any modification to these Terms constitutes your acceptance of the revised Terms.
The Operator shall have no liability to you or any third party for any modification, suspension, or discontinuation of the Service.
As a courtesy, these Terms may be made available in languages other than English. In the event of any inconsistency, conflict, or ambiguity between the English-language version of these Terms and any translated version, the English-language version, as published at img9.net/terms or img9.net/en/terms, shall prevail and govern in all respects. Translated versions are provided for convenience only and carry no independent legal force.
Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other provision of these Terms. The remaining provisions shall continue in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent.
Entire Agreement. These Terms, together with the Privacy Policy and the Impressum, constitute the entire agreement between you and the Operator regarding your use of the Service and supersede all prior agreements, understandings, and communications, whether written or oral.
Waiver. The failure of the Operator to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms shall be effective only if in writing and signed by the Operator.
Governing Law. These Terms shall be governed by and construed in accordance with the laws applicable to the Operator as identified in the IMG9 Impressum, without regard to conflict of law principles. Any disputes arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts competent for the Operator's registered seat.
Assignment. You may not assign or transfer your rights or obligations under these Terms without the prior written consent of the Operator. The Operator may assign its rights and obligations under these Terms without restriction.
